Sohini Mandal, Jr Partner of Novojuris talks about how the ICC functions. How do you setup PoSH Act at Branch Offices.
Sexual harassment at work place refers to unwelcome behaviour towards women often to intimidate or offend them. This could affect our confidence, willingness to work, the right to financial freedom and safe workplace. Sexual harassment is often very subtle. It includes not only physical but verbal advancements that make women uncomfortable. Hence we are in dire need of a law that mandates quick and appropriate actions from management and doesn’t leave a loophole. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 aims to do the same.
Primarily POSH Act at branch offices is meant to identify and prevent sexual harassment at work place. This act covers all women, irrespective of her age or employment status, sector and includes clients, customers and domestic workers as well.
This act mandates sexual harassment forum in companies and constitution of Internal Compliance Committee (ICC) on the same. It means no matter how many branches we have, we should appoint ICC for each and every place of business apart from central headquarters.
